This is obviously a lawyer throwing everything out there that has any chance at sticking. It's what good lawyers do. I don't think this ends up coming back on the staff or university at all but it does hurt Tremell's individual case if it's true.


With regards to Tremell, there's nothing in this lawsuit that hasn't been known for at least 6-8 months. The only new pieces are the alleged involvement of coaching staff and knowing the extent of the young man's injuries. And, even that is a little unclear. I know the lawsuit mentions TBI (traumatic brain injury), but there's a very wide range of TBI's. A concussion is a traumatic brain injury, and having your entire brain scrambled by a bullet is a traumatic brain injury. The phrase by itself is not much more descriptive than saying something like "leg injury"---which could be anything from a pulled hamstring to a gash to a traumatic amputation of the leg.

I still think the fact that a specific coach is not named in the lawsuit is strange, if they know such an event took place.

Yes it certainly makes no sense to not identify the "coach " since they are essentially blaming him for an enhanced injury. With regard to Brain injuries, every plaintiff's lawyer who practices today tries to convince their clients that they have a traumatic brain injury. People who get rear ended at 5 mph. People who fall two feet. People who experience absolutely no head trauma. There is an entire traumatic brain injury business which includes lawyers, "therapists" and neuropsychologists who will testify that anybody who has ever had any sort of trauma has a brain injury.

You left out people who have been shot in the head.

Yeah it's hard to buy the notion that this is just a lawyer embellishing given the nature of what happened. A bullet probably would cause a TBI. It's possible the lawyer could be lying\stretching the truth but it just feels unlikely in this case.

If a bullet had entered his head that would be true. Based on everything I have heard this was a case of a non-penetrating graze. Of course I don't know if that is accurate, but I never heard anything different and early accounts seemed to indicate he was talking to police at the scene.

The suit sites 'permanent vision loss' and alteration to his gait. It wouldn't necessarily take the bullet entering his skull to cause that.

You likened it to a car accident and you know what happens after a car accident involving personal injury? Everybody gets sued. Its the only way anything gets done. I'm guessing the university and Tremell settle out of court, the victim gets paid for his injuries and Tremell can move on without this following him around for the rest of his life.

Please stop posting about this. You have no idea what you are talking about and obviously have no clue what damage can be caused by being shot in the head, whether it entered your skull or not. And honestly, thats really beside the point here anyways.

There's no question that Tremell should own the responsibility for this young man's injuries. However, as a college student, he likely has very little money, so it would be pointless for a jury to award him to pay a large sum of money to the plaintiff, as he likely doesn't have it. I'm not a lawyer, but I don't know how you could hold either the landlord or Drake responsible for this unfortunate incident.

It's a bad situation, obviously, but not sure what the answer is. Tremell has already been charged with the relevant crimes, and paid his dues, so to speak. I just feel like this is one of those situations where, in the end, the lawyers will be the only ones happy.

Right the only way Drake would be in any way liable is if the allegation that the coach told Murphy to lie\cover it up can be proven. In that case, Drake could certainly be on the hook for a massive lawsuit, or maybe it would be the coach directly but somebody would be sued in a big way and they should be.

They can go after all future earnings and garnish his pay for as long as it takes to make full restitution. It sucks but negligence has consequences.
